About the platform
These terms govern your use of this website and the arbitration administration platform behind it. By using it you accept them. If you do not accept them, do not use it.
Nyaya Setu
The platform helps lenders run loan-default arbitrations: it receives case data, sends notices, tracks delivery, hosts documents and hearings, and keeps a record. It is operated by an arbitration administrator.
What the administrator does and does not do
- The administrator administers the process. Independent arbitrators make every legal decision.
- The administrator does not choose or rank arbitrators automatically. A person records each appointment, with the basis and the reasons.
- No administrator role edits the text of an order or an award.
- Nothing on the platform is legal advice. If you are a respondent, you may take your own legal advice at any time.
- The platform does not handle money. It never asks for, receives or transfers a payment. A lender may report an update to a loan as information only.
Accounts and case links
- Staff, lender and arbitrator accounts are created by invitation. Keep your credentials and authenticator codes to yourself and tell us at once if you think they are compromised.
- Respondents open a case through a link sent in a notice. The link works once and needs a one-time code sent to your registered mobile number. Do not share the link or the code.
- You are responsible for what is done through your account or link until you report a problem.
Acceptable use
You must not:
- use the platform for anything other than the case or role it was given to you for;
- upload unlawful material, or malware, or a file you have no right to share;
- try to access another party's case or data, bypass access controls, probe or overload the system;
- pretend to be another person, or send a notice or filing in a name that is not yours;
- record or share a hearing contrary to the arbitrator's directions.
We may suspend access to protect the platform or a case. Actions on the platform are recorded in an audit log.
Documents and records
Notices, filings and awards on the platform are the records of the arbitration. Delivery statuses and proofs of service show what the channel providers reported to us. A status such as "delivered" is a provider report, and whether service is complete for a case is decided under the rules that apply to that case and, finally, by the tribunal or a court.
Your uploads remain yours. You allow the administrator, the lender and the tribunal to use them for the arbitration and its enforcement.
Availability
We aim to keep the platform available but do not promise uninterrupted service. Third-party services (messaging, email, video, storage) can fail or delay. The platform tracks such failures and, for notices, tries other channels. Deadlines in a case run under the notice and the tribunal's directions, not under the platform's uptime. If you could not use the platform when a deadline fell, tell the tribunal or hello@abirnyayasetu.com as soon as you can.
Liability
To the extent the law allows, the administrator is not liable for indirect or consequential loss arising from use of the platform, or for failures of third-party networks or services outside its control. Nothing in these terms limits liability that cannot be limited by law, or any right you have under the Digital Personal Data Protection Act, 2023.
Governing law and jurisdiction
These terms, and any dispute about this website or these terms, are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction.
This is separate from the arbitrations administered on the platform. Each arbitration follows its own arbitration agreement, its seat and the Arbitration and Conciliation Act, 1996. Nothing in these terms changes the seat, the rules or the jurisdiction of an arbitration, or a court's powers over it under that Act. The platform administers; independent arbitrators decide.
Personal data is handled as set out in the Privacy Policy, under the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000. Electronic records, notices and the audit log on the platform are kept so that they can be used as electronic records under Indian law.
Changes and contact
